Participation Agreement: General conditions for makers
§ 1 General provisions
Make it asbl (referred to as „organiser“), a non-profit association registered in Luxem-bourg and organising the Luxembourg Mini MakerFaire (referred to as the “Faire”) from May 16, 2020to May 17, 2020 in the educational compound “am Bongert” in Rosport (refered to as the “site”), is granting participation to individual persons or legal entities (referred to as “makers”) under the conditions stated hereafter. The Faire will be a free event that is expected to draw an audience (referred to as “visitors”) of about 1,500 children and adults from throughout the region.
§ 2 Application / Participation
The participation requires the prior acceptance to the event. The declaration of participa-tion by the maker is binding. The participation to the Faire is possible following a written (e-mail is sufficient) confirmation of the acceptance by the organiser. The approval is only valid for the persons and/or legal entities identified during the application with the an-nounced products or services. Any change needs a written confirmation by the organiser.
The maker engages himself in displaying the announced items during the full duration of the Faire and to have his booth / display area permanently occupied.
With the application to the event, the maker agrees to comply with all applicable laws, the Maker Manual, and any other requirements, and/or rules issued in connection with the Faire.
In case of a legal entity, the applying person guarantees having the full authority to act on behalf of this legal entity.
§ 3 Liability
The maker is solely responsible for his material, presentation and/or representation (re-ferred to as „exhibit“) and is participating to the Faire at his own risk. The maker is liable towards the organiser, the visitors or any third person for his exhibits as stated by the ap-plicable laws. The maker is responsible for obtaining any permissions required for his performance, distribution, or posting of copyrighted material; for obtaining any necessary licenses and permits; and for payment of all taxes (including sales and use taxes), li-cense fees, or other charges applicable to his participation in the Faire. The maker frees the organiser and its associated event partners of any claims by third parties in these re-gards.
The organiser is only liable for damage associated to gross negligence or intentional breach of duties of the organiser himself, his legal representatives or his appointed agents. Liabilities of harm to life, body or health remains untouched.
§ 4 Cancellation
The organiser may terminate, unilaterally and without prior notice, the participation of any individual person or legal entity in the Faire if he/it violates the conditions stated herein or in the Maker Manual.
In case of Force Majeure (“höhere Gewalt”) or on grounds of administrative orders or for safety reasons, the organiser may change the setting of the Faire or cancel the Faire be-fore or after its start.
The organiser cannot be held liable in any way if it cancels the Faire for any reason at any time, and the maker waives any claim or potential claim if the Faire is cancelled, and holds harmless the organiser or its associated event partners from any resulting or relat-ed liability, cost, expense, or damage.
§ 5 Right to one's own image / image rights
The Faire is a public event promoting the maker movement. The maker acknowledges that he and his other representatives, as well as all his authorized assistants’ and his or his organization’s or company’s exhibit(s), may be recorded in audio, visual, and/or au-diovisual media by the organiser and/or its event partners and subcontractors. The maker consents to the making and use of such recordings by the organiser and/or its event partners, such uses including without limitation the transcription, modification, reproduc-tion, public display, distribution, broadcast, and transmission in any form. The maker re-leases the organiser and its partners from and waive any claims related to or arising by reason of the making and/or use of any such recordings.
The maker grants the organiser and its event partners the right to use in connection with the promotion and production of the Faire, its name and any trade name and/or logo. The provisions of this paragraph will survive termination of this Agreement.
§ 6 Additional provisions
The maker confirms to be 18 years of age or older and, in case of a legal entity, to be fully authorized to act on behalf of this entity. Makers aged below 18 years of age shall submit a written consent of his participation to the Faire signed by a parent or legal guardian. The website luxembourg.makerfaire.com and the application form for makers are located on servers managed by make it asbl and by Make Community LLC. Personal data will only by used in relation to the organisation and the planning of the Faire and in accordance to the general data protection regulation of the EU. The place of Jurisdiction is Luxembourg. The laws of the Grand-Duchy of Luxembourg apply.
